WINFIELD -- Three men are suing over claims a hostile work environment led to their resignations.
Kevin Gibson, Leo Clark and Gary Jarvis filed a lawsuit June 30 in Putnam Circuit Court against Andritz Separation Inc. and Charles Manigan, citing unlawful employment practices.
According to the complaint, the three plaintiffs were employed by Andritz in its Scott Depot facility, where they came under the supervision of Manigan. The plaintiffs say they experienced death threats, racial slurs, physical intimidation, abusive language about age and general hostility from Manigan throughout their employment, which they repeatedly reported to management, which failed to remedy the situation.
The plaintiffs were caused to resign due to the hostile work environment with several having been forced to seek therapy.
The defendants are accused of constructive discharge, negligent hiring, retention and supervision, negligent infliction of emotional distress, outrage and hostile work environment.
The plaintiffs are seeking damages, lost wages and benefits, attorney's fees and travel and moving expenses used to find other work. They are being represented in the case by attorneys Hoyt Glazer, Ben Sheridan and Mitchell L. Klein of Klein, Sheridan and Glazer LC in Huntington. The case has been assigned to Circuit Judge Joseph Reeder.
