Act Now - SF2311 Amendment Impacts Solar Energy

An energy efficiency amendment to Senate File 2311 last week allows new charges to be levied on solar arrays, and is a back door approach to apply discriminatory pricing to solar energy customers by utilities.

House Amendment 8268 specifically allows utilities to recover costs from “all customers on a reasonably comparable basis, including customer who utilize alternative energy production facilities as defined in section 476.42.” This suggests that even customers with solar arrays (included in the definition of “alternative energy production facilities," along with ag-based generation technologies and others) would need to pay. This likely could take the form of a new fixed charge.
