The bizarre defence emerged at the High Court in Glasgow as nine members of Scotland’s biggest crime group appeared a day after after being jailed for a total of 87 years.

We told yesterday how the Crown want SCPOs slapped on the clan to "own them" when they’re eventually freed.

Mhairi Richards QC, for O’Neill - who was jailed for seven years and four months - said: “I have concerns about how this procedure has been adopted.

“Mr O’Neill is married with a family.

“He will not be able to sit on his own couch with his child and play Xbox in the terms of the order sought.”

Scots crime supergang warned cops will ‘own them’ for life after being caged for 87 years over torture, drugs and violence

Judge Lord Beckett said: “I would encourage you and the Crown to speak to each other to reach a resolution.”

Ms Richards replied: “I think it is a shut door.”

After top prosecutor Alex Prentice shook his head, Judge Beckett said: “The order must be right.

“The risk is the court adjudicates and it’s not suitable to anyone.”

Earlier, two of the gang, Gerard Docherty, 42, and Steven McArdle, 33, accepted SCPOs banning them from associating with listed person for five years on their release.

The people concerned were not revealed in court.

Docherty was caged for ten years and six months after a shooting at the home of ex-boxer Robert Kelbie in Edinburgh, while McArdle got seven years and 100 days for possessing a Glock handgun.

O’Neill and the remaining six members - David Sell, 50, Anthony Woods, 44, Francis Mulligan, 41, Michael Bowman, 30, Mark Richardson, 30 and Martyn Fitzsimmons, 37 - will return to court on Friday for a further hearing.
