Federal judge stops UNC from enforcing HB2

CHAPEL HILL, NC (WBTV) - A federal judge issued a ruling late Friday prohibiting the University of North Carolina from enforcing the 'bathroom' portion of House Bill 2.

The controversial bill was passed by the North Carolina General Assembly in a one-day special session earlier this year. Among the provisions included in the law was a requirement that people must use public restrooms corresponding to the gender listed on their birth certificate.

The law is being challenged in federal court by a group of individuals represented by the American Civil Liberties Union and, separately, by the United States Department of Justice.

Friday's ruling comes at the request of students and faculty enrolled in and employed by the University of North Carolina system.

In issuing the injunction, the federal judge ruled that HB2's 'bathroom' provisions likely violate Title IX, as interpreted in recent guidance from the United States Department of Education.

The judge's order said UNC must accommodate students and employees on a case-by-case basis, unlike the blanket rule created by HB2.

"In short, UNC may not apply HB2's one-size-fits-all approach to what must be a case-by-case inquiry," the ruling said.
