미국은 경제제재법, 행정명령, 행정규정 등을 이용하여 쿠바, 이란, 시리아, 북한 등 국제사회의 안보에 위협이 되는 국가들에 대하여 포괄적 경제제재를 시행하는 대표적인 국가이다. 그 중에서도 이란과 쿠바는 미국의 대표적 제재대상국으로서 각각 1970년대와 1960년대부터 경제제재가 시작되어 현재까지 시행되고 있다. 미국은 이들 국가를 대상으로 하는 경제제재 특별법을 제정하고 다수의 행정명령 및 이에 근거한 행정규정을 발효하는 것을 통해 포괄적인 제재체계를 구축하였다. 특히 제재국가와 거래하는 제3국의 기업, 은행, 정부 등에 대하여 미국 내 파트너와 거래를 금지하는 세컨더리 제재를 이용하여 두 국가를 더욱 효과적으로 압박하였다. 하지만 2015년에 미국은 대화를 통하여 이란과의 JCPOA를 체결하고 쿠바와의 국교정상화를 이루어내며 오랜 제재 정국에 큰 변화를 가져왔다. 이란과 쿠바에 대한 경제제재는 현재 완화 중이며 이는 행정명령과 규정의 개정을 통해 시행된다. 대부분의 경우, 대통령의 행정명령에 의해서 완화의 첫 단계가 시작되며 이를 반영하기 위하여 관련 행정부서가 제재 규정을 개정하는 형태로 진행된다. 반면, 제재의 완전한 해제는 대통령의 의지만으로는 어려우며 경제제재법에서는 의회의 동의가 필수적이라는 것을 명시하고 있다. 미국은 상대국의 협의 이행 여부에 따라 단계적으로 제재를 완화하는 방식을 고수한다. 따라서 제재의 완전한 해제를 위해서는 오랜 시간이 걸리는 것이 일반적이며, 파격적이고 즉각적인 제재 해제는 기대하기 어렵다. 그러나 이러한 단계적인 완화조치만으로도 현재 이란과 쿠바는 예전보다 활발한 경제적 자유를 누리고 있다. 북한 역시 이란과 쿠바와 마찬가지로 미국의 오랜 제재대상국이지만 두 국가와는 다르게 미국과 관계개선에 대한 대화가 전혀 이뤄지지 않고 있다. 오바마 전 대통령은 이란과 쿠바에 대해서는 관계개선을 위해 적극적인 행보를 보였으나 북한에 대해서는 ‘전략적 인내’라는 정책을 고수하며 다소 소극적으로 대응하였다. 북한은 이 기간 동안에도 꾸준히 핵을 실험하고 미사일을 개발하는 등 국제평화에 위협이 되는 행위를 멈추지 않았다. 2017년에 취임한 트럼프 대통령은 북한의 이같은 군사적 도발행위를 더 이상 용인하지 않을 것을 강조하며 필요한 경우에는 무력 사용도 불사할 것이라고 밝혔다. 미국이 북한에 대한 강력 대응을 시사하며 한반도의 긴장은 나날이 고조되고 있다. 이란과 쿠바 역시 한때는 미국과 가장 적대적인 관계를 유지하였지만 지금은 화해모드에서 차근차근 제재 해제를 위한 단계를 밟아가고 있다. 이는 모두 미국과의 대화를 시작하며 생겨난 역사적인 변화이다. 만약 북한도 미국과 대화의 기회가 생긴다면 무력충돌을 피하면서도 평화로운 방식으로 관계에 새로운 방향을 모색할 수 있을 것이다.

The United States imposes comprehensive sanctions against the countries that pose threat toe the international community, such as Cuba, Iran, Syria, and North Korea. Among these States, Iran and Cuba are the mostly sanctioned countries. The sanctions against Iran started in 1979, and the sanctions against Cuba began in 1962. The United States enacted several law and issued numerous executive orders to strengthen the sanctions regime against these countries. The United States’ use of secondary sanctions made the sanctions more effective. But in 2015, there seemed to be a change in the US foreign policy objectives, as the JCPOA was reached among the P5+1 countries and Iran, and the foreign relations were restored between the US and Cuba. The Sanctions Iran and Cuba are currently being waived and/or revoked. These changes are illustrated through the modifications of the relative regulations and executive orders. In most cases, the changes in the sanctions regime begin by the issuance of executive orders. The detailed changes to the daily transactions due to the sanctions relief are brought by the modified regulations. The complete lift of sanctions, however, is difficult to achieve as it requires the approval of the Congress. The United States relieves the sanctions in a slow and phased process. Therefore, it generally takes a very long time for a complete relief from sanctions, and it is difficult to expect a complete sanctions relief in an instant. Though the sanctions relief on Iran and Cuba may be limited, Iran and Cuba have benefited from the recent sanctions relief. North Korea, just as Iran and Cuba, is a heavily sanctioned country. However, unlike Iran and Cuba, the relationship between the US and North Korea is not getting better. Former President Obama acted actively on achieving the deals with Iran and Cuba, but he did not show such zeal with respect to North Korea. Obama administration’s ‘strategic patience’ with North Korea did not bring major changes to their relationship. North Korea continued to develop WMD and carried out nuclear tests despite all the sanctions. President Trump emphasized that the United States will no longer tolerate the military acts by North Korea, leading to the rise in tensions on the Korean Peninsula. Iran and Cuba, once categorized as ‘the Rogue States’ by the United States, have undergone some major changes, and are now making progress with the lift of sanctions. This historical change took place after they normalized relations with the United States. The same can happen to North Korea if both the US and North Korea are willing to resolve the nuclear issue through peaceful talks. It might not result in a perfect deal, but it could result in a better one, where the use of force is not involved.
