Congratulations on joining Welcome to Impact Founder’s Coaching Programs. We’re so excited you’re here, and we can’t wait to see what your Next Level Life looks like. As with any professional service, there are some stipulations and regulations. Here’s what you need to know:

This Agreement is made today between Impact Founder and the person initialing at the end of this document, [the Client]. The Program in which you are about to enroll in will include the following:

SCHEDULING & CANCELLATIONS

1:1 Coaching
Impact Founder understands that our clients have busy schedules and we take pride in not keeping them waiting or keeping them longer than planned. Each session will end 30-60 minutes after it was scheduled to begin. Please be on time. After 15 minutes past the scheduled time of your appointment, it will result in a “lost appointment” and the fees paid will not be refunded.

Group Coaching Sessions
The Group Accelerator includes 24 ninety-minute intensive sessions that will consist of training, tools, peer support, group coaching and feedback, and high level coaching and consulting support. For your $4000 investment, you are going to get a level of support, accountability, and training that some founders and entrepreneurs don’t even know is possible! We have a couple of policies:If you miss a session you lose that session. If the Client needs to reschedule the appointment, the Client must do so 48 hours in advance; otherwise, the Client will forfeit that appointment, all fees associated with it and will not have an opportunity to reschedule the session.

PAYMENTS AND REFUNDS
The Client understands that the regular cost of the Program is a monthly subscription fee and it automatically renews monthly on the anniversary date of the first payment. In the event of the Client’s absence or withdrawal, for any reason whatsoever, no refunds will be issued for the current month.

DISCLAIMERS
The Client understands that the role of the Coach is not to prescribe medication or assess micro- and macronutrient levels; provide health care, medical or nutrition therapy services; or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, the Coach is a mentor and guide who has been trained in holistic health and/or life coaching to help clients reach their own goals by helping clients devise and implement positive, sustainable lifestyle changes. The Client understands that the Coach is not acting in the capacity of a doctor, licensed dietician-nutritionist, psychologist or other licensed or registered professional, and that any advice given by the Coach is not meant to take the place of advice by these professionals. If the Client is under the care of a healthcare professional or currently uses prescription medications, the Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor or therapist.

The Client has chosen to work with the Impact Founder Coach and understands that the information received should not be seen as psychiatric, medical or nursing advice and is not meant to take the place of seeing licensed health professionals.

PERSONAL RESPONSIBILITY AND RELEASE OF HEALTH CARE RELATED CLAIMS
The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after this program.

The Client expressly assumes the risks of the Program, including the risks of trying new foods or supplements, and the risks inherent in making lifestyle changes. The Client releases the Impact Founder and assigned Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against Impact Founder and the Coach, arising from the Client’s past or future participation in, or otherwise with respect to, the Program, unless arising from the gross negligence of Impact Founder and the assigned Coach.

ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES
In the event that there ever arises a dispute between Impact Founder Coach and Client with respect to the services provided pursuant to this agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Client in the event that an award is granted in arbitration is refund of the Program Fee. Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to the Client.

This agreement shall be construed according to the laws of the State of Colorado. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force.

If the terms of this Agreement are acceptable, please sign the acceptance below. By doing so, the Client acknowledges that: (1) he/she has received a copy of this letter agreement; (2) he/she has had an opportunity to discuss the contents with the Coach and, if desired, to have it reviewed by an attorney; and (3) the client understands, accepts and agrees to abide by the terms hereof.

Confidentiality
Coaching is held within strict professional confidentiality; however, it is not protected by law, and we are required to suspend confidentiality in the following cases:

You report imminent suicidal or homicidal ideation.
You report abuse or neglect of a child, dependent, or elderly adult.
We are ordered by court of law to do so.
You report anything that causes concern for the health or safety of yourself or others.

We will be recording each call for our own quality review and for anyone that misses a session.

Copyright Protection
The Group Accelerator may share handouts, templates, and tools with you as part of our work. These are the intellectual property of The Group Accelerator and our affiliates, and you are forbidden to use or reuse them for financial gain or otherwise distribute or remarket to any third parties, unless otherwise instructed. You are forbidden to reproduce them without express permission.

Health and Well-Being
Please note that you are responsible for your health and well-being during coaching. If you have any questions regarding your ability to participate in coaching, please consult your doctor or healthcare professional.

The Group Accelerator is 100% committed to you being powerful, fulfilled, and creating the life you want. If during our time together there occurs any reason to change our agreement, the request is that we look at the issue(s) and create a mutual resolution that honors the client, The Group Accelerator, coaches, and the partnership.

Coaching is designed to provide access to power, freedom, and fulfillment in your life. This is done through distinguishing things that are inconsistent with the results you are committed to producing. While clients may experience a sense of healing or catharsis as a byproduct of the work, coaching is not intended to take the place of therapeutic or psychiatric care, if needed for client’s health and well-being. Coaching is not medical in nature. Coaching is sometimes triggering, confronting, or uncomfortable. It is the client’s responsibility to attend to their mental and emotional health.

Refunds
Coaching is, by design, a confronting process. At times, the client may feel fear, discomfort, or feel unable or unwilling to move forward on a project. While the coach understands that this may be a normal part of the process, the coach is also committed to standing for you to deliver the results you committed to, without being stopped by fear or uncertainty. We cannot and do not offer refunds on monies paid. The coaching relationship is a professional engagement, and once the services are agreed upon and money paid, the service is available.
