GCMS notes contain a lot of sensitive information, from your application number, UCI number, medical records in certain cases, your personal details, bank details, employment details and much more. This is the reason why the Government of Canada classifies GCMS notes under ‘Protected B’ category.
Protected B – Applies to information or assets that, if compromised, could cause serious injury to an individual, organization or government.
To ensure that the data and personal information is protected by private organizations, Canadian parliament passed the Personal Information Protection and Electronic Documents Act (PIPEDA).
The law gives individuals the right to
- know why an organization collects, uses or discloses their personal information;
- expect an organization tocollect, use or dis
- close their personal information reasonably and appropriately, and not use the information for any purpose other than that to which they have consented;
- know who in the organization is responsible for protecting their personal information;
- expect an organization to protect their personal information by taking appropriate security measures;
- expect the personal information an organization holds about them to be accurate, complete and up-to-date;
- obtain access to their personal information and ask for corrections if necessary; and
- complain about how an organization handles their personal information if they feel their privacy rights have not been respected.
The law requires organizations to
- obtain consent when they collect, use or disclose their personal information;
- supply an individual with a product or a service even if they refuse consent for the collection, use or disclosure of your personal information unless that information is essential to the transaction;
- collect information by fair and lawful means; and
- have personal information policies that are clear, understandable and readily available.
Is your information and notes safe?
A lot of new immigrants are prone to identity theft, which may ruin your credit score, you ability to take loans, and apply for employment in certain cases. Protecting your information is your responsibility and it starts way before you land in Canada. You should ensure that you do not disclose your information to third parties, and where you disclose, the third parties are in compliance with the Canadian Laws. Please be advised that Canadian laws can only be enforced on companies incorporated in Canada. A lot of companies claiming to be in compliance with Canadian privacy laws are not, as they are not even present in Canada or registered as per the law. Offence
10 (1) Every person who, without reasonable cause, contravenes section 2 or 2.1 or subsection 4 (4) or (6) or submits a statement in an application for a registration under this Act that is false or misleading with respect to any material fact is guilty of an offence and on conviction is liable to a fine of not more than $2,000 or, if the person is a corporation, to a fine of not more than $25,000. R.S.O. 1990, c. B.17, s. 10 (1); 1998, c. 18, Sched. E, s. 37.
