Members of academia are invited to express their support for our imprisoned colleague Benny Tai Yiu-Ting (戴耀廷), an associate professor at the University of Hong Kong (HKU) Faculty of Law, who is at risk of wrongful dismissal.

In April 2019, Professor Tai was found guilty of conspiracy to cause public nuisance and inciting others to cause public nuisance and sentenced to sixteen months imprisonment for his role in the ‘Occupy Central with Love and Peace’ campaign. In the first-instance verdict against him, Judge Johnny Chan rejected Professor Tai's argument that he had merely engaged in peaceful civil disobedience and ought not to be punished.

We understand from press reports and social media that calls have since been made for Professor Tai's dismissal from HKU. Attempts to further punish Professor Tai for his peaceful efforts to promote democratic values in Hong Kong represent a distressing threat to values that are fundamental to higher education, including freedom of expression, academic freedom, and institutional autonomy.

We invite scholars from all disciplines to sign the below open letter urging HKU to guard Professor Tai from politically motivated disciplinary measures, and to protect the University's autonomy and, by extension, its reputation as a distinguished institution known around the world for independent research, open inquiry, and freedom of speech.

Dear President Zhang,

We, the undersigned academics, are writing to express deep concern about our colleague, Professor Benny Tai Yiu-Ting (戴耀廷), an associate professor at the University of Hong Kong (HKU) Faculty of Law, who was convicted and sentenced to sixteen months imprisonment in connection with his role in a civil disobedience movement. We respectfully urge you to ensure the autonomy of HKU by taking appropriate steps to guard Professor Tai from politically motivated dismissal or other disciplinary measures.

As a scholar at Hong Kong’s oldest law school, Professor Tai has made many distinctive and widely noted contributions to academic debates about the rule of law, constitutionalism, legal culture and law and religion in Hong Kong and beyond. Some of his most recent work has addressed the topics of civil disobedience, democratic decline and authoritarianism.

We understand from media reports and campaigns in the social media that there have also been calls for Professor Tai's dismissal from HKU, although he is currently appealing both his conviction and sentence.

Civil disobedience is the refusal to follow specific rules of the law in service of higher legal principles; it rests centrally on faith in the rule of law as it is practiced in a free and democratic society. As one of Hong Kong’s most important centres of free thought and inquiry, HKU has long supported the values civil disobedience seeks to defend and promote. Any move to dismiss an academic as a result of a conviction arising from peaceful advocacy could cause irreparable harm to the stature of the University as a champion of independent thought.

Before he left office in 2017, your predecessor in the office of President and Vice-Chancellor, Professor Mathieson, rightly observed that the university is not a surrogate courtroom. While Professor Tai has expressed his willingness to accept criminal punishment in service of his convictions, he should not be additionally punished by losing his academic position.

We are therefore writing to urge you to do what is in your power to protect Professor Tai’s position in the University. Further, we urge you and the University leadership to protect the University’s autonomy and, by extension, its reputation as a distinguished institution known around the world for independent research, open inquiry, and freedom of speech.
