The Federal Supreme Court (STF) formed today (8) a majority of votes to confirm the decision that extended until March 31, 2022 the prohibition of evictions and repossessions against vulnerable families during the covid-19 pandemic.

So far, seven ministers have followed the vote given by the rapporteur, minister Luís Roberto Barroso, who, last week, extended the deadline until March of next year and established that the measure is valid for rural and urban properties.

In another decision on the case, signed in June this year, Barroso banned the evictions until 3 December. The decisions were motivated by an action filed by PSOLl and human rights entities.

In the minister's understanding, the existence of 123,000 families threatened with eviction in the country justifies the exceptional nature of the decision.

“In the context of the covid-19 pandemic, the social right to housing is directly related to health protection, given that housing is essential for social isolation, the main mechanism for containing the virus. In view of this exceptional situation, property, possession and land rights need to be balanced against the protection of the life and health of vulnerable populations”, he argued.

The case was taken to trial in the virtual plenary, a modality in which ministers deposit their votes electronically, without the need for a face-to-face meeting.
