OP relocated from LA to NY shortly after AOS package submission (relocated from one FO with a known long processing timeline to another one equally with a known long processing timeline). In addition, OP's submitted medical report was missing a required vaccine, they subsequently received a RFE from the LA office for an updated medical report. LA FO upon realizing OP was no longer under their jurisdiction to the address change sent back the AOS file to the NBC for reallocation to the New York FO (before the requested updated medical report was received) | |||||||

Front-loaded as suggested. - Apr 19, Received an email from KCCDV@state.gov stating that "Adjustment of Status - Fee Not Paid" (330$). Indeed, the proof of payment is missing in the filing but the fee was paid. Replied to the email and attached the receipt (paid stamp on March 15th) that was delivered to me on Mar 30, right after I sent my filing. - Apr 27, received RFE request to provide proof of DV Processing Fee (330$) payment. Same day sent response with original RFE, cover letter, SASE received with stamp that the fee was paid on March 15th, and copy of the Cashier Check (customer copy). - Approximately on May 5 I received another RFE to confirm number of applicants who is adjusting the status. DOS needs an explanation why only primary applicant is adjusting the status. The thorough explanation as a cover letter & and all required proof docs were sent on May 10th & delivered to Chicago FO on May 12th. No update of the status after that. - June 28, I sent an inquiry email myself to the DOS > KCCDV@state.gov. The inquiry was regarding if the DV case was successfully transferred to the USCIS or still on DOS side. Based on what I read on state.gov site there was no need to pay DV fee for applicants that are not eligible for AOS. Received reponse from DOS on June 29th stating: Please direct your inquiry to the Citizenship and Immigration Services (CIS) at 1-800-375-5283 or visit https://uscis.gov. - June 28, after 60 days from the first RFE is sent, I have requested a Tier 2 specialist assistance via Emma-bot. - June 29, received a call from a Tier 2 specialist. I verbally shared the chronology of the RFE requests and responses, provided an USPS tracking number of the latest response. Specialist said that she will send an inquiry email to Chicago FO and said that I should receive a response from FO in 30 days or sooner (fingers crossed). | ||

USCIS has denied my case on the ground of not maintaining an immigrant status and pending asylum doesn’t guarantee a status just like you explained earlier. My lawyer wants to file a motion and we will give it another shot just in case. Everybody here has been really helpful and especially you mom. I’ve attached a letter just incase if anyone wants to go through and i suggest people who are in pending asylum please do not lose hope as there are cases where pending asylee with DV lottery winner has also been able to adjust status.
