Is California a strict liability dog bite state?
According to Section 3342 of the Civil Code in California, we can see that this state operates under a “strict liability” dog bite statute. This means that a dog owner can be held liable for any injuries caused by a dog bite, even if the dog has never bitten anybody before or been deemed aggressive. This differs from some other states that have a “one bite” rule in which a dog owner can only be held liable after a dog has been deemed aggressive or bitten somebody previously.
However, California’s strict liability laws only apply to injuries caused by a dog bite, not other injuries caused by an attack. For example, if a person is injured because a dog knocked them over and broke their bone, then the injury victim will need to prove negligence on the part of the dog owner to recover compensation.
How long do victims have to file lawsuits in a dog attack case?
If you are injured by a dog, you should immediately contact Animal Control and have the incident investigated. For a dog attack case, injury victims must remember the time limit set by the California Personal Injury Statute of Limitations. Under these laws, injury victims will have a two-year window to file a lawsuit against a dog’s owner to recover compensation. Failing to file a claim within this specified time will result in the injury victim being unable to recover the compensation they deserve. You should also obtain proof the attacking dog was adequately vaccinated and take photos of the dog, your injuries, and any witnesses.
