ROUTES RENTALS SNOWSHOE WAIVER, RELEASE, AND CONSENT

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT BY SIGNING THIS AGREEMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE

ASSUMPTION OF RISK
The undersigned (hereafter referred to as “The Lessee(s)”) hereby release and discharge Routes Rentals & Tours, Inc., and any associated organization (including but not limited to independent contractors, restaurants, hotels, sponsors, volunteers, school districts, municipalities, churches, clubs, and any employee or associates thereof) their heirs, administrators, agents and employees, from any and all liability, causes of action, suits, debts, contracts, agreements, claims and demands whatsoever as a result of my rental and use of the equipment listed on this form (“the Equipment”). The Lessee(s) freely accept full responsibility for the Equipment, and agree to pay for any damage to the Equipment and replace the Equipment at the full retail value if damaged to such an extent that repairs are not feasible or practicable, or if lost or stolen for any reason / due to any circumstance.

The Lessee(s) are aware that snowshoeing involves risks, dangers and hazards and those injuries are a common and ordinary occurrence of this sport. These risks, dangers and hazards include but are not limited to: collision with natural or man made objects, including rocks, stumps, trees and mechanical snow grooming equipment; collision with skiers, snowboarders, vehicles, sleds, or other snowshoes; snowshoeing onto ice or broken snow; inclement weather, varying or severe snow, ice, wind, weather, white-out and avalanche conditions; the presence of objects, wholly or partially obstructed from view; the Lessee(s) physical coordination and balance; the speed at which the Lessee(s) travel; the Lessee(s) ability to use/control equipment and follow directions; operator error and/or equipment failure; remote routes and inadequately marked trails which may lead to the Lessee(s) becoming lost or disoriented; cold weather and heat-related injuries and illnesses including frostnip, frostbite, heat exhaustion, sunstroke, hypothermia and dehydration; negligence of other persons participating in winter sports; and negligence on the part of Routes Rentals & Tours, Inc., its members, directors, officers, and any employee, independent contractor, or associate thereof. The Lessee(s) understand and acknowledge that the above list is not complete or exhaustive, and that other risks, known or unknown, identified or unidentified, anticipated or unanticipated may also result in bodily injury, death, illness, or damage to the Lessee(s), to their property, or to others. The Lessee(s) expressly accept any risks not specifically listed above, and represent that their use of the Equipment is entirely voluntary.

The Lessee(s) are also aware that backcountry travel by snowshoes involves risks, dangers and hazards, and that backcountry travel should not be attempted without specific training and equipment. The Lessee(s) understand that the boot / binding system for the Equipment is not designed or intended to release and will not release under normal circumstances. The Lessee(s) understand that as the boot / binding system of the Equipment is a non-release system, this system will not reduce the risk of injury during a fall and will increase the risk of not surviving an avalanche. The Lessee(s) understand that their use of the Equipment, including safety equipment, cannot guarantee their safety or freedom from injury while snowshoeing. The Lessee(s) are aware that it is not possible to predict every condition or circumstance under which the equipment and safety equipment will not operate as intended. The Lessee(s) freely accept and fully assume all such risks, dangers, and hazards, and the responsibility for personal injury, death, property damage, and loss resulting therefrom.

INDEMNIFICATION & HOLD HARMLESS
Lessee(s) hereby further agree to indemnify and hold harmless Routes Rentals & Tours, Inc., its officers, agents, employees, and independent contractors from any and all claims made by or on behalf of any third person or entity as a result of Lessee(s) use of the equipment rented from Routes Rentals & Tours, Inc. Lessee(s) further agree to reimburse Routes Rentals & Tours, Inc., its officers, agents, employees, and independent contractors for any expenses including but not limited to attorneys fees and costs incurred by them as a result of such claims made on behalf of any third person or entity arising from Lessee(s) use of Routes Rentals & Tours, Inc. or The Equipment.

SECURITY DEPOSIT
All participants must provide a credit card at the start of the rental. There will be no charge on the card. The information will only be used in the case of damage or loss of property. The Lessee(s) understand that a security deposit of $100 will be taken for the first adult snowshoes and poles rental and $50 for each additional rental / $50 for

each child snowshoes and poles rental included as part of the Equipment, and The Lessee(s) agree to allow this amount to be authorized on the credit card(s) provided by the Lessee(s) to Routes Rentals & Tours, Inc. Routes Rentals & Tours, Inc. shall reserve the right to modify the required deposit amount at the sole discretion of its officers, agents, employees.

RENTAL PERIOD & LATE CHARGES
The Lessee(s) agree to adhere to the rental period(s) noted above and agree to return the rentals no later than the "End Date" time listed. The Lessee(s) agree to pay charges of the full-day rate for rentals that are returned to the Lessor after the return date/time for each day the rental is tardy. After 3 days late, the Lessee(s) understand and agree to charges made on their credit card for the full retail amount of the rental item(s). The time period of the rental may be extended by calling Routes (505-933-5667) during business hours, and only if the items is available for additional rental periods. Lessor has the right to deny rental period extension for all items currently on rent.

MARKETING / PROMOTION
Lessee(s) hereby agree to give Routes Rentals & Tours, Inc. permission to use my first name and likeness in any photographs, motion pictures, recordings, evaluations, or any other non-confidential record of my rental of The Equipment for any promotional purposes, without obligation or liability to the Lessee(s).

The Lessee(s) have read and understand the above information, and all Routes Rentals & Tours, Inc. policies, and certify compliance by digitally check-marking the terms on this site. The Lessee(s) agree that this complete Waiver, Release, and Consent is binding on their heirs, proxies, representatives, and assigns for their entire rental group.

ASSUMPTION OF RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19
Routes Bicycle Tours & Rentals, Inc. (“Routes”) has put in place preventative measures to reduce the spread of COVID-19 in accordance with federal and state guidelines; however, Routes cannot guarantee that you or your party will not become infected with COVID-19. Further, engaging in activity with Routes including but not limited to attending a Routes tour or event, renting equipment with Routes, or visiting a Routes brick and mortar location (collectively, “Activities”) could increase your risk and your Travel Party’s risk of contracting COVID-19.

By digitally signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that myself, any minor children and additional members of my Activities with Routes for whom I have the capacity to contract (“Party”) may be exposed to or infected by COVID-19 by engaging in any Routes Activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Routes may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Routes employees, partners, my Party, and other customers/guests and their families.
