TERMS AND CONDITIONS - the terms and conditions below are binding as an agreement on all persons who participate in the TDC Mega Rewards Incentive Programme.
WORDS WE USE IN THIS AGREEMENT
"account" means the account maintained in our records in respect of points awarded to and redeemed by you and related information and includes a joint account in the names of two persons.
“account number” means the assigned number, which identifies you as a participant in the programme.
"corporate customer" means a customer which is a limited liability company or an entity other than a natural person which is authorized by us to participate in the programme.
"person" includes a natural person and a corporate customer. “points" means points awarded in respect of qualifying purchases.
“programme" means the TDC Mega Rewards Incentive Programme
"qualifying purchase" means any purchase made during the qualifying period from us in respect of which points are awarded under the programme.
“qualifying credit account” means an open charge account on which we record goods and services obtained by a customer from us on monthly credit terms and which is approved by us for participation in the programme.
“qualifying period” means the period of six months commencing on the date of your last qualifying purchase.
"you" "your" and "account holder" means a person to whom we issue an account and include, as the context requires, any person duly authorized to use the account.
"we" "our" "us" and "TDC" mean St. Kitts Nevis Anguilla Trading and Development Company Limited and its departments and subsidiaries engaged in the programme.
ELIGIBILITY
1. Participation in the programme is limited to the holders of accounts in accordance with these terms and conditions.
2. We may, in our sole and absolute discretion, and without prior notice to you, suspend or terminate your participation in the programme if you violate any of these terms and conditions, misrepresent any information to us, withhold any information reasonably required by us relative to your participation in the programme, engage in fraud or abuse relating to the programme or facilitate or participate in any such fraud or abuse by any other person.
3. Your participation in the programme may also be revoked or limited by us in our sole and absolute discretion, at any time and without compensation by thirty (30) days notice to you.
4. Notice may be given under this section by email or, if you have not given us an e-mail address, by ordinary post. Notice will be deemed to have been received by you on transmission of the e-mail from our system or two days after postage.
5. In the event that we terminate your participation all unreedemed points will be forfieted at the effective date of termination.
6. If you do not make any qualifying purchases for the qualifying period you shall forfeit all unredeemed points and we reserve the right to terminate your participation in the programme.
7. Each person named on a joint account is entitled to make qualifying purchases or redeem points on that account. Joint holders are jointly and severally liable to TDC.
EARNING POINTS
1. You will begin to earn points when you have made qualifying purchases of XCD$1.00. You shall be awarded one point for each dollar of qualifying purcases (XCD$1.00 = 1 point)
2. If you have a qualifying credit account, points in respect of qualifying purchases will be provisionally credited to your account. You will become entitled to those points only if (and when) the balance on the qualifying credit account is paid promptly on or before the due date. If payment is not made promptly on or before the due date, the points provisionally credited will be removed from your account.
3. Points posted in error to your account and points posted provisionally to a qualifying credit account which is not settled in accordance with Clause 2 of this section will be reversed.
4. The programme does not apply to hire purchase transactions or to layaway plans or to purchases for which payment is made by instalments.
5. You must present the account number or name to our cashier prior to completion of the qualifying purchase. Points will not be applied to your account after a cash transaction is completed by the
cashier.
6. We may, in our sole and absolute discretion, credit points to your account in respect of qualifying purchases made by another person on your behalf if that person presents your account number or
name, once authorisation is given by the account holder to do so.
7. Points will be credited to the account of a corporate customer in respect only of qualifying purchases made by a representative of the corporate customer whose authority to bind the corporate customer is shown on the application form completed to join the programme or otherwise in writing acceptable to us.
8. Points have no cash value and do not constitute your property for any purpose. Points can be earned only in accordance with these terms and conditions.
REDEEMING POINTS
1. Points can be redeemed only in accordance with these terms and conditions.
2. Points may be redeemed at any retail store of any member of the TDC Group of Companies.
3. Points cannot be used to settle accounts.
4. You must present you account number or name to the cashier in order to redeem points. We may in addition to your presentation of the card, and in our sole and absolute discretion, require you to
produce Government issued personal identification in order to redeem points.
5. We may in addition to your presentation of the card and/or account number, and in our sole and absolute discretion, request the presentation of Government issued personal identification, in order
to redeem available points.
6. Points expire in twelve (12) months from the date earned in a calendar year.
OTHER TERMS AND CONDITIONS
We can (subject to applicable law) change, modify or cancel any aspect of the programme including these terms and conditions. We will notify you of any changes to the programme or to these terms and
conditions by notice in any manner set out in the following paragraph of this section.
We may give you notice of any matter set out in the preceding paragraph of this section by e-mail to your e-mail address given on the application form or by notice posted on our website. You are responsible for notifying us of any change of your e-mail address
You shall be deemed to have received such notice when the e-mail is sent from our system to your e-mail address or when the notice is posted on our website.
An electronic system will be used to store and operate your account. In the absence of manifest error the information shown on such system shall be final and binding on you.
Subject to applicable law, we are not liable to you and you release us, our officers, directors, employees and agents from any and all claims arising from or related to:
(i) any cause, condition or event whatsoever that is beyond our direct control,
(ii) the suspension or termination of the programme for any reason,
(iii) the suspension or termination of your membership in the programme or
invalidation of any or all of your points or the cancellation of your account, (iv) the suspension or cancellation of any points,
(v) notice that is delayed or otherwise misdirected and/or any consequence of that, or
(vi) limitations on qualifying purchases.
In no event will we or any of our officers, directors, employees and agents be liable to you for any consequential, indirect, exemplary or punitive damages.
Points have no monetary or cash value and do not constitute legal tender whatsoever and cannot under any circumstances form the basis of a monetary claim against us, our officers, directors, employees and agents.
If any of these terms and conditions is held to be unenforceable then all other terms and conditions shall remain in full force and effect.
