Building a Better Cathedral City: The Crucial Role of an Updated Zoning Ordinance

All incorporated cities and counties are required by the California Government Code to prepare a comprehensive, long-term general plan, which directs the development of the community. As an official document of the City of Cathedral City, the General Plan provides the goals, policies, and programs to guide the development of the City. The City of Cathedral City adopted its General Plan update in 2021, casting a vision for the City through 2040. The General Plan vision statement provides a unifying message for the overall planning document:

“A sustainable Cathedral City that continues to grow culturally and economically, that celebrates and embraces diversity, that provides a wide variety of housing and employment opportunities, that ensures community health and safety, that protects and celebrates the environment, and that promotes a high quality of life for all of its residents.”

This vision statement is supported by multiple plan elements, including those covering such subjects as housing, transportation, and land use. Each of those plan elements contain goals, policies, and programs that facilitate the implementation of the General Plan. The City’s Zoning Ordinance also has a significant role in the plan implementation.

The development and enforcement of the City Zoning Ordinance is an exercise of police powers granted to the City by the State and is the primary tool for implementing the General Plan. The Zoning Ordinance regulates land use by distinct development zones and permitted uses. Text, maps, diagrams, and other materials describe the distribution and intensity of land uses into such categories as residential, commercial, and industrial uses. Written regulations establish minimum development standards for each of the land use zones in a manner consistent with the General Plan. Permitting processes set forth in the Zoning Ordinance, including Conditional Use Permits, Variances, Architectural Reviews, and other land use permitting, also implement the General Plan.

While the City of Cathedral City’s Zoning Ordinance has been reviewed following updates to the General Plan, including those made in 2021, and has been amended from time to time in response to new state laws and emerging policy issues, the Zoning Ordinance has not been substantially changed or modified since the City’s incorporation in 1981. It remains reliant on permitting processes and procedures, development standards, and design guidelines that were established several decades ago. While many of these continue to work for the City, the importance of the Zoning Ordinance to achieve the goals, policies, and programs of the General Plan cannot be understated and it requires a comprehensive review and update.

The City’s Zoning Ordinance is one of the most important regulatory tools the City has – it is used to make every day decisions on permits ranging from block walls to residential additions or expansions. It is also the framework for new construction and development in Cathedral City, defining the planning and zoning standards and review processes for development proposals, including subdivisions and commercial development.

In recent years, cities across the country have worked to incorporate more certainty and predictability into their zoning codes. This has the effect of both setting clear standards for residents and existing businesses together with providing new businesses a sense of what to expect as they submit an application to the City for review. In some cases, it can cost an applicant hundreds of thousands of dollars to prepare an application submittal to the City and it may be months or years before they are in a position to know whether their application meets the City’s standards. This increases risk to a prospective developer, and it may lead them to seek an opportunity in another city where they have more certainty over what to expect than working with Cathedral City. This, in turn, impedes housing development and reduces economic development opportunities and the creation of jobs in Cathedral City.

The Cathedral City Development Services Department will be launching an effort this year to comprehensive update the City’s Zoning Ordinance to ensure that it is offering residents, businesses, and prospective developers the certainty and predictability they need while continuing to work to implement the General Plan. This will be a significant endeavor with multiple opportunities for public engagement.
